Terms of service and acceptable-use policy
The rules we work under, and ask you to
1. What we provide
Registration of your messaging program with the carriers and their registries, a phone number, a web portal for your team to manage contacts and send messages, handling of replies and opt-outs, and support during your program. On the managed plan the messaging account is ours; on the your-account plan it is yours and we operate inside it with the access you grant.
2. Consent: your responsibility
You confirm that you have prior express consent, as required by the Telephone Consumer Protection Act and applicable state law, to send text messages to every number on any list you upload or import, that you keep records of that consent, and that you will not upload purchased, rented or scraped lists. You will provide those records to us on request if a carrier, registry or regulator asks. You are responsible for any claim arising from messages sent to people who did not consent.
3. Content and conduct
- Every message includes a way to opt out, and opt-outs are honored automatically and permanently. You will not try to text a number that has opted out.
- Messages are sent between 8 am and 9 pm in the recipient's local time.
- Message content must match the program you registered: the same sender, topics and frequency you told the carriers.
- Candidate and committee messages carry the disclosures required by law, including Utah Code 20A-11-901 for Utah political advertising.
- No content the carriers prohibit: sex, hate, alcohol, firearms or tobacco promotion; illegal activity; threats or harassment; deceptive sender identity; public link shorteners.
- No misrepresentation of who is sending or of the election process.
4. Registration and fees
Our onboarding fee covers the registration work, including resubmissions. Fees the registries and carriers charge (brand registration, campaign vetting, monthly campaign fees) and Campaign Verify's fee are set by those bodies and are non-refundable once submitted, whether or not the program is approved. Monthly platform fees are billed while your program is active. Prepaid message blocks on the managed plan are used at the published per-segment rate and are refundable for the unused balance if your program ends.
During our launch period we waive our own onboarding and platform fees for programs we accept; any fee we do charge is confirmed to you in writing before work begins. Third-party fees (Twilio usage, Campaign Verify, carrier and registry fees) remain yours in every case.
5. Suspension
We may pause a program without notice if a carrier, registry or Twilio flags it, if we see sending to opted-out numbers or outside allowed hours, or if messages depart from the registered program. We will tell you why and what would resolve it. Repeated or serious violations end the agreement.
6. Your data
Your contacts, consent records, messages and replies are yours. You can export them at any time and we return or delete them when the program ends, keeping opt-out records so they remain honored. We do not use your data for any other client or purpose.
7. Service limits and liability
We run the service carefully but cannot guarantee that carriers will approve a program, deliver every message, or maintain any throughput, and we are not responsible for carrier filtering or outages. Our total liability to you for any claim is limited to the fees you paid us in the three months before the claim. You agree to indemnify us against third-party claims that arise from your lists, your content or your violation of these terms.
8. Ending the agreement
Either side may end the agreement with written notice. Fees already incurred remain due. On the managed plan we will port your number to an account you control on request.
9. General
These terms are governed by the laws of the State of Utah. Changes to these terms are posted here with a new effective date and apply to programs going forward. Questions: [email protected].
